Council Decisions: September 19, 2023

Here is a summary of the decisions of Rocky View County Council at the September 19, 2023 Council Meeting. This is a general overview of decisions only. General Business 

  • Langdon Area Structure Plan Update - Council voted to direct Administration to: 
    • Prepare a budget adjustment and terms of reference outlining the scope, principles, and timeline of a Langdon ASP review project, which includes investigation of potential expansion of the ASP boundary. 
    • Engage with the interested parties to investigate costs associated to undertake the review project. 
    • Present the budget adjustment and terms of reference to Council no later than the end of November 2023. 
  • Council voted to rescind the Terms of Reference for the Bragg Creek Hamlet Expansion Strategy project, and directed Administration to include the hamlet expansion lands within the scope, timeline, and budget of a new terms of reference to amend the overall hamlet policies of the Bragg Creek Area Structure Plan, to brought back to Council no later than January 31, 2024. 
  • Council voted to approve the County’s application for a Forest Resource Improvement Association of Alberta grant in support of the Vegetation Management Project that assists homeowners in the reduction of fire risk in the Greater Bragg Creek area. 
  • Council voted to approve the Joint Use School Planning Agreement between Rocky View County, Rocky View Schools, Calgary Catholic Schools, and the Francophone Regional Authority that allows for a transparent process between all parties when planning the future and current needs for school and recreational sites. 
  • Council voted to deny the request for late tax payment penalty cancellation from the owner of Tax Roll 04319198 in accordance with Late Tax Payment Penalty Cancellation Policy C-204. 
  • Council voted to deny the request for late tax payment penalty cancellation from the owner of Tax Roll 04606516 in accordance with Late Tax Payment Penalty Cancellation Policy C-204. 
  • Council voted to deny the request for late tax payment penalty cancellation from the owner of Tax Roll 04617006 in accordance with Late Tax Payment Penalty Cancellation Policy C-204. 
  • Council voted to deny the request for late tax payment penalty cancellation from the owner of Tax Roll 04702185 in accordance with Late Tax Payment Penalty Cancellation Policy C-204. 
  • Council voted to deny the request for late tax payment penalty cancellation from the owner of Tax Roll 05618225 in accordance with Late Tax Payment Penalty Cancellation Policy C-204. 
  • Council voted to deny the request for late tax payment penalty cancellation from the owner of Tax Roll 06704042 in accordance with Late Tax Payment Penalty Cancellation Policy C-204. 
  • Council voted to deny the request for late tax payment penalty cancellation from the owner of Tax Roll 06827291 in accordance with Late Tax Payment Penalty Cancellation Policy C-204. 
  • Council received, for information, a Declaration of Insufficient Petition against the Local Improvement Plan for Meadow Ridge Road, Conrich Estates. The affected landowners will now be notified of the insufficient petition. 
  • Council voted to approve Special Event Bylaw C-8364-2023 encompassing amendments to the original Special Event Bylaw C-7990-2020, including clearer definition to event types, an amended submission deadline, stronger notification language, and additional language to secure appropriate compliance to legislative requirements. 
  • Council voted to approve Appeal and Review Panel Bylaw C-8438-2023 encompassing amendments to the original Appeal and Review Panel Bylaw C-7717-2017, including policy changes for the County’s Subdivision and Development Appeal Board (SDAB) and Enforcement Appeal Committee (EAC), and update a selection of the Appeal and Review Panel Bylaw’s administrative references. 
  • Council then approved a Motion Arising directing Administration to schedule interviews with Council, with the SDAB/EAC candidates for the purpose of filling the SDAB/EAC vacancies at the October 17, 2023 Organizational Meeting. 

Planning and Development 

  • Division 5 – File: PL20230039 (06411011), Bylaw C-8413-2023, Redesignation Item: To assess a site-specific amendment to the DC-99 Direct Control district to allow for a Commercial Communication Facility (Type C) use, specifically a 45.00 metre (±147.64 feet) high tower with side and rear setbacks of 2.00 metres (6.56 feet), on Lot 3, Block 1, Plan 0811034 within SW-11-26-29-W04M. Considered under the Balzac East Area Structure Plan, and the Wagon Wheel Conceptual Scheme. Approved. 
  • Division 1 – File: PL20220119 (04705011), Bylaw C-8335-2022, Redesignation Item: To assess redesignation of W-05-24-03-W05M from Agricultural, Small Parcel District (p8.1) to Residential, Rural District to facilitate future subdivision of a 7.89 hectare (19.50 acre) parcel to create three (3) new lots, all measuring a minimum of ±1.62 hectares (4.00 acres) in size. Considered under the County Plan. Refused. 
  • Division 5 – File: PL20230063 (07305002), Bylaw C-8437-2023, Redesignation Item: To redesignate of a portion of the subject lands from Agricultural, General District to Residential, Rural District to accommodate the future subdivision of a ± 1.62 hectare (4.00 acre) lot from the existing ± 61.04 hectare (± 150.83 acre) parcel. Considered under the City of Airdrie/Rocky View County Intermunicipal Development Plan. Approved. 
  • Division 5 – File: PL20220079 (06224010), Bylaw C-8423-2023, Redesignation Item: To redesignate a ± 3.94 hectare (± 9.73 acre) portion of the subject lands within NW-24-26-27-W04M from Agricultural, Small Parcel District to Commercial, Local Rural District and a ±17.75 hectare (± 43.86 acre) portion of the subject lands from Agricultural, Small Parcel District to Agricultural, Small Parcel District (p12.1). The application proposes the noted land use amendments to accommodate the development of an autobody repair and paint shop. Considered under the Calgary Metropolitan Region Growth Plan, and County Plan. Refused. 
  • Council voted to approve, with conditions and related amendments, development permit application PRDP20233260 encompassing a commercial-scale solar farm, solar farm infrastructure, ancillary uses (including substation), and over height fencing within Section 26, Township 27, Range 29, West of the 4th Meridian. Considered under the Calgary Metropolitan Region Growth Plan, and the County Plan. 

Closed Session 

  • Council moved into a closed session to consider the confidential item “Chestermere Regional Community Association (CRCA) Legal Matter” under Sections 21, 24, 25, and 27 of the Freedom of Information and Protection of Privacy Act. Council moved back into the public session and directed Administration to proceed with Mandate #2 as discussed in confidential report RVC2023-32. 
  • Council moved into a closed session to consider the confidential item “Calgary Airport Authority Board of Directors Appointment Review” under Sections 17, 19 and 24 of the Freedom of Information and Protection of Privacy Act. Council moved back into the public session with no follow up action. 
  • Council moved into a closed session to consider the confidential item “CAO Hiring Process” under Sections 24 and 25 of the Freedom of Information and Protection of Privacy Act. Council moved back into the public session and voted to appoint Mr. Rick MacDonald as the Interim Chief Administrative Officer effective October 1, 2023, in accordance with the Municipal Government Act, and that the budget adjustment of $150,000 be approved as per RVC2023-35 Attachment ‘A’, publicly distributed at the September 19, 2023 Council meeting. Council then approved that the Acting Chief Administrative Officer be directed to initiate the request for proposal process of hiring a permanent Chief Administrative Officer.
