Notice of Proposed Franchise Agreement

Public Notice is hereby given pursuant to sections 45(3) and 606 of the Municipal Government Act for the proposed grant of a water, wastewater, and storm water utility franchise agreement for the Carmek Business Park, as well as the accompanying Bylaw C-7721-2017 respecting the grant of the franchise agreement to 2035570 Alberta Limited.
The location of the proposed franchise agreement is the Carmek Business Park Lands (previously referred to as the Emcor Business Park).
Pursuant to the Municipal Government Act, the County has the ability to:
- Grant a right, exclusive or otherwise, to a person to provide a utility service in all or part of the municipality, for not more than 20 years;
- Grant a right, exclusive or otherwise, to use the municipality’s property, including property under the direction, control, and management of the municipality, for the construction, operation, and extension of a public utility in the municipality for not more than 20 years; and
- Charge a fee, rate, or toll for the use of its property, including property under the direction, control and, management of the municipality for the purpose of operating the utility.
The proposed bylaw and franchise agreement will be considered by Rocky View County Council at the October 10, 2017 Council Meeting, which will begin at 9:00 a.m. at the County Office located at 911 – 32 Avenue N.E., Calgary, Alberta T2E 6X6. The franchise agreement for the Carmek Business Park is required to be executed prior to endorsement of Phase 1A of subdivision application PL20150125, which was approved by County Council at the July 26, 2017 Council Meeting. The franchise agreement is subject to approval from the Alberta Utilities Commission pursuant to Section 45 of the Municipal Government Act.
Bylaw C-7721-2017 is not subject to petition under sections 222 – 226 and 231 of the Municipal Government Act, as only the franchise agreement is required to be advertised. In lieu of petitions, any concerns, objections, or support may be filed with the approval process conducted by the Alberta Utilities Commission pursuant to its forthcoming advertisement of the Notice of Application for approval of the franchise agreement.
