Council Decisions: January 21, 2025

Here is a summary of the decisions of Rocky View County Council at the January 21, 2025 Council Meeting. This is a general overview of decisions only. General Business

Administration presented a report update regarding Council’s respectful workplace training recommended by the County’s Complaints Adjudicator, relating to the consideration of a code of conduct matter at the November 26, 2024 Council meeting. Council voted to move into a closed session to consider confidential item “Code of Conduct Recommendations and Training” under Sections 23, 24, and 27 of the Freedom of Information and Protection of Privacy Act (FOIP). Council moved back into the public session, and approved that further consideration of this item (F-1 on today’s meeting agenda) be postponed until the February 4, 2025 Council Meeting.

Council voted to approve the 2025 Tax Sale Conditions for County properties with three years’ worth of outstanding tax arrears. The tax sale will take place on October 3, 2025, with terms to include the acceptance of cash or certified cheque, a 10% deposit at the time of sale, and payment of the remaining 90% balance within 30 days of receipt by Rocky View County, plus GST.

Council voted to approve amendments to the Community Recreation and Culture Grant Funding Policy C-317 to more clearly identify the intended use of approved funding through this grant program, which supports community organizations that provide recreational and cultural programs and services to County residents.

Council voted to approve a budget adjustment of $80,000 from the Tax Stabilization Reserve for the large maintenance items of the six baseball diamonds located in Langdon for 2025.

Council voted to approve amendments to Servicing Standards Policy C-412 as part of its regular policy review process. Policy C-412 establishes the County’s Servicing Standards as the minimum requirements for the design, construction, and maintenance of infrastructure associated with development proposals within the County.

Planning and Development

Division 7 – File: PL20240107 (03214411), Bylaw C-8598-2025, Direct Control Amendment Item: To assess the proposed site-specific amendment to Direct Control Bylaw C-5783-2003 (DC-85) affecting the subject lands to reduce the minimum side yard setback requirement from 1.50 metres (4.92 feet) to 0.13 metres (0.43 feet) to allow an existing plastic shed to remain. The proposed amendments represent a variance of 91% to the overall side yard setback requirement in the area. Accessory Buildings are not permitted within side yards within DC-85; therefore, the amendments facilitate the location of the Accessory Building for the individual property only. Considered under the Calgary Metropolitan Region Board Growth Plan, the Langdon Area Structure Plan, and the Boulder Creek Conceptual Scheme. Refused.

Division 6 – File: PL20240131 (04332010), Bylaw C-8602-2025, Redesignation Item: To assess redesignation of the subject lands from Residential, Rural District and Residential, Rural District (p4.0) to Agricultural, Small Parcel District (p8.1) to accommodate an existing non-compliant Accessory Building. The proposed redesignation is a result of enforcement action, as the existing Accessory Building (shop) was constructed without a Development Permit and Building Permit. Considered under the Calgary Metropolitan Region Board Growth Plan, Rocky View County/City of Calgary Intermunicipal Development Plan, and the Conrich Area Structure Plan. Refused.

Division 3 – File: PL20240181 (06822002/06/07/11/20), Bylaw C-8604-2025, Land Use Bylaw Amendment Item: To assess an amendment to the Residential, Mid-Density Urban District and Residential, Small Lot District within the Land Use Bylaw, to allow for a reduction in side yard setbacks to 1.5 metres (4.92 ft.) on both sides of a parcel for principal buildings, excluding corner lots, within the Cochrane Lake Neighbourhood ‘C’ Conceptual Scheme. Considered under the Cochrane North Area Structure Plan, the Cochrane Lake Hamlet Plan Area Structure Plan, and Cochrane Lake Hamlet Plan Neighbourhood ‘C’ Conceptual Scheme. Approved as amended.

Council voted to refuse application PL20240015, Bylaw C-8566-2024, to close a ±24.10 m (± 79.07 ft) portion of laneway totaling ±0.015 hectares (±0.037 acres) created as part of subdivision plan 8556 CI in NW-12-23-05-W05M in the Hamlet of Bragg Creek in order to facilitate future consolidation with Lot 8, East Part within NW-12-23-5-W5M. Council also directed Administration to cease outreach activities with the landowners along the laneway on Bracken Road on this proposal.

Closed Session

Council moved into a closed session to consider the confidential item “Policy Review Advisory Committee Discussion” under Section 24 of the Freedom of Information and Protection of Privacy Act (FOIP). Council moved back into the public session, and directed Administration to prepare a report for Council’s consideration regarding the dissolution of the Policy Review Advisory Committee.

Council moved into a closed session to consider the confidential item “Prairie Gateway Update” under Sections 17, 21, and 24 of the Freedom of Information and Protection of Privacy Act (FOIP). Council moved back into the public session, and voted to have Senior Administration meet with the City of Calgary’s Senior Administration to identify and clarify any ongoing issues underlying the final deal agreement and report back to Council on progress in February 2025.
