Council Decisions: March 28, 2023

Here is a summary of the decisions of Rocky View County Council at the March 28, 2023 Council Meeting. This is a general overview of decisions only. General Business

  • Council received, for information, a report from Recreation, Parks and Community Support outlining the budgetary estimates and life cycle costs to add approximately 25 parking stalls to the existing gravel parking lot for the public recreation area in Blueridge Estates. Council directed Administration to include this project as part of the 2024 budget discussions.
  • Council denied the request for late tax payment penalty cancellation from the owner of Tax Roll 03223787 in accordance with Late Tax Payment Penalty Cancellation Policy C-204.
  • Council denied the request for late tax payment penalty cancellation from the owner of Tax Roll 03231021 in accordance with Late Tax Payment Penalty Cancellation Policy C-204.
  • Council denied the request for late tax payment penalty cancellation from the owner of Tax Roll 06404316 in accordance with Late Tax Payment Penalty Cancellation Policy C-204.
  • Council granted an extension for Administration to present the Terms of Reference for an Aggregate Resource Plan to Council no later than April 11, 2023.
  • Council approved, with amendments, the 2023 Master Rates Bylaw C-8386-2023 outlining the fee changes identified for various Rocky View County services, and as referenced in the 2023 Operating and Capital Base Budget, approved at the December 14, 2022 Special Council meeting. The 2023 Master Rates Bylaw C-8386-2023 will come into effect on April 1, 2023.
  • Council then approved a Motion Arising directing Administration to bring a report on the County’s Utility Financial model to the September 12, 2023 Governance Committee. The report, to be provided before the tabling of the County’s 2024 Operating Budget, is to include recommendations for a Long-Term Rate Strategy which recognizes:
    • Best practice approaches in rate setting
    • Long term capital obligations, and
    • Unified rates vs. individual system rates.
  • Council approved a Motion first read into the record on March 28, 2023 supporting Mayor Kissel’s and Councillor Schule’s application to serve on the RMA Committee on Quasi-Judicial Agencies and that the County shall be responsible for per diem costs associated with participation.

Planning and Development

  • Division 1 – File: PL20210057 and P20210058 (04721006 and 04721022), Bylaw C-8203-2021 and Bylaw C-8302-2021, Conceptual Scheme and Redesignation Item: PL20210058 (Bylaw C-8203-2021) - To adopt the Willow Ranch Conceptual Scheme to provide a policy framework to guide future redesignation, subdivision, and development proposals on Plan 811 1225, Blocks 1 & 2; within SE 21-24-03 W5M. PL20210057 (Bylaw C-8202-2021) - To redesignate ± 12.4 hectares (± 30.63 acres) from Residential, Rural District to Residential, Country Residential District; redesignation of ± 2.99 hectares (± 7.39 acres) from Residential, Rural District to Special, Natural Open Space District (S-NOS); and redesignation of 0.49 hectares (1.21 acres) from Residential, Rural District to Special – Public Service District in order to facilitate future subdivision of the subject parcel into 12 residential parcels, two Environmental Reserve Parcels, and one Public Utility Lot. Considered under the Central Springbank Area Structure Plan. Approved as amended.
  • Division 3 – File: PL20220139 (06708005), Bylaw C-8383-2023, Redesignation Item: To redesignate a ± 10.93 hectare (± 27.08 acre) portion of the ± 31.94 hectare (± 78.93 acre) subject parcel from Agricultural, General District to Residential, Rural District to facilitate future subdivision of three new lots. Considered under the Bearspaw Area Structure Plan. Approved as amended.
  • Division 6 – File: PL20220048 (02233016), Bylaw 8352-2022, Redesignation Item: To redesignate the subject lands from Agricultural, Small Parcel District to Residential, Rural District (p2.0) and Residential, Rural District (p4.2) to facilitate future subdivision of one new lot. Considered under the County Plan. Approved.
  • Division 6 – File: PL20200075 (03330003) – Council approved the terms of sale agreement for Closed Road Plan 1820 AM for the subject lands to be sold to 1599203 Alberta Ltd. (Davinder Sehrai) for the purpose of consolidation with Block 3, Plan 1820 AM within SW-30-23-28-W04M. The sale is subject to the following conditions:
    • Sales agreement being signed at the appraised value of $56,000;
    • A condition being included in the sales agreement requiring a six metre-wide drainage easement to be registered on the northerly boundary of the closed road allowance to support possible connections for the Co-operative Stormwater Management Initiative (CSMI); and
    • The terms of the sales agreement being completed within one year of Bylaw C-8095-2020 receiving third and final reading.
  • Division 4 – File: PL20210026 (05632011), Subdivision Application Item: To create four parcels ranging from ± 1.62 hectares (4.00 acres) to 2.36 hectares (5.83 acres). Considered under the Bearspaw Area Structure Plan. Approved as amended.

Closed Session

  • Council moved into a closed session to consider the confidential item “Request for direction on Development” under Sections 24 and 25 of the Freedom of Information and Protection of Privacy Act. Council moved back into the public session and voted that Development Report RVC2023-09 be received as information.
  • Council moved into a closed session to consider the confidential item “CAO Performance Evaluation” under Sections 17 and 19 of the Freedom of Information and Protection of Privacy Act. Council moved back into the public session, with no follow-up action.
