Council Decisions: September 11, 2018

Here is a brief summary of the decisions of Rocky View County Council at the September 11, 2018 Council Meeting. This is a general overview of decisions only. Specific details can be found in this meeting’s agenda (see the Council Minutes and Archives page), or in the minutes of this meeting that will be printed in the next Council Meeting agenda. Details are also available by contacting the County’s Legislative and Legal Services department.

General Business

  • Council voted to reschedule the October 9, 2018 regular Council Meeting to October 16. The rescheduled meeting will be the first held in the new County Hall. The regular September 25 Council Meeting will be the last held in the current administration building in Calgary.
  • Council directed Administration to negotiate a final sales agreement for County land currently housing a surplus Grader Shed. The County acquired the land in 1960, but following annexation it is now located in Airdrie. The market value of the land has been established at $723,000 ($300,000 per acre).
  • Amendments to the Municipal Government Act require Rocky View County to complete an Inter-Municipal Collaboration Framework and Inter-Municipal Development Plan with all adjacent municipalities that are not a member of the Calgary Metropolitan Region Board. The work must be completed by April of 2020. Council made several Inter-Municipal Collaboration Framework and Inter-Municipal Development Plan Review Committee appointments to help develop these frameworks and plans:
    • Councillors Kissel and Kamachi were appointed to the committee for Rocky View County and the Municipal District of Bighorn.
    • Reeve Boehlke and councillors Kissel and Henn were appointed to the committee for Rocky View County and Mountain View County.
    • Reeve Boehlke was appointed to the committee for Rocky View County and Kneehill County.
    • Deputy Reeve Gautreau and councillor Schule were appointed to the committee for Rocky View County and Wheatland County.
  • All Divisions – File 3000-300: Council approved Third (Final) Reading of Firearms Bylaw C-7782-2018. First and Second readings were completed on May 22 at a public meeting, and the bylaw went to the Provincial Minister of Environment and Parks for approval before final Council approval. The bylaw establishes No Shooting zones in certain areas of the County, mostly in hamlets and areas of higher population density.
  • Council voted to allocate $140,000 from the Reserve Tax Stabilization Fund to support ten percent of the costs of detailed engineering studies on an emergency-only access road that would serve the Bragg Creek area. The allocation allows the County to apply for the remaining 90 percent of the cost of the studies from the Government of Canada and the Province of Alberta under the National Disaster Mitigation Program. Should the federal/provincial grant application prove unsuccessful, the County would not spend its portion.

Planning & Development

  • All Divisions – File 1014-554 – Bylaw C-7816-2018 – Land Use Bylaw Amendments – Recreational Cannabis Regulations. Approved.
  • Division 9 – File PL20180013 (08815008), Bylaw C-7800-2018, Re-designation Item: New or Distinct Agricultural Use – Ranch and Farm District to Agricultural Holdings District. Considered under the County Plan. Approved.
  • Division 2 – File PL20180062 (04716009), Bylaw C-7815-2018, Re-designation Item: Residential Two District to Residential Three District. Considered under the Central Springbank Area Structure Plan. Approved.
  • Division 9 – File PL20180032, Road Plan 6397I: Road closure located in NW-0827-04-W5M for consolidation purposes. Council approved the closure, and the County will now request the Alberta Minister of Transportation also grant approval. If ministerial approval is received, Council directed Administration to enter into a land sale agreement with the adjacent landowner for the sum of $11,000 plus related costs.
  • Division 7 – File PL20180069 (6411017), Re-designation Item: Site Specific Amendment to Direct Control Bylaw C-6031-2005 (DC-99). This item received First and Second Reading at a public hearing on July 21. Council rescinded Second Reading and instructed Administration to advertise the reopening of the public hearing on October 23 to specifically address odour and emissions management issues.

  • Division 7 – File PL20180047 (06415050), Subdivision: Balzac East Area, Residential One District. Approved by the Subdivision Authority.
  • Division 1 – File PL20180068 (03915057), Subdivision: Residential One District. Approved by the Subdivision Authority.
  • Division 2 – File PL20180014 (04726009), Subdivision: Residential Two District. Approved by the Subdivision Authority.

In Camera

  • Council moved in camera to consider the report “Land Jurisdiction.” The report was in camera pursuant to the Freedom of Information and Protection of Privacy Act, sections 21 (disclosure harmful to intergovernmental relations) and 24 (advice from officials). On moving out of the in camera session, Council approved a confidential mandate to Administration on the issue.
  • Council moved in camera to receive a report on the County’s agricultural land located in the Town of Cochrane. The report was in camera pursuant to the Freedom of Information and Protection of Privacy Act sections 21 (disclosure harmful to intergovernmental relations), 24 (advice from officials), and 25 (disclosure harmful to economic and other interests of a public body). On moving out of the in camera session, Council voted to keep the matter confidential.
